Medical Waiver of Training Requirement
Medical Waiver
For a medical waiver, the individual must be on short-term or long-term disability for an extended period. While on medical, the individual’s certification and annual training requirements are on hold until the individual returns to work. Any deficiency in training must be completed before returning to active status. Depending on medical dates, the individual will receive a waiver of some or all of the annual training requirements. A physician’s note must be attached to this form stating that the individual is prohibited from participating in any training due to the medical condition.
The following procedure applies to peace officers on medical leave or has been on medical leave in the training year.
Requesting Medical Waiver
- A medical waiver form with a physician’s note stating the individual cannot participate in training must be received from the primary agency.
- If the officer is currently on medical, the form will include the start date, and the end date is left blank. If the medical leave is over, the agency should include the start and end dates.
- The medical waiver is for officers on short-term or long-term disability. The waiver is not allowed for “light duty” or “temporary assignment” situations.
- To start the waiver process, email support@utahpost.org and request a waiver form be sent to your chief administrative officer (or designee) to be completed and digitally signed.
Medical Waiver Calculation
- If the medical occurs during the entire training year, the officer does not have a training requirement for that year and may become active upon return.
- If the medical is a partial year, the hours are prorated by each full quarter worked. For each full quarter, the officer worked, 10 hours are required towards the 40-hour requirement.
- There is no waiver for Arrest Control, De-Escalation, Crisis Intervention, Special Needs, and Sexual Abuse/Assault Investigation requirements.
- For example, An Officer sustained an injury and was placed on short-term disability from 10/15 to 2/1 in the training year. The officer’s training requirement for the year would be 20 hours in total. Since the officer fully worked the first (Jul-Sep) and last (Apr-Jun) quarters of the training year.
Medical Peace Officer Status
- If the officer is currently on medical leave, the employment status is changed to Active (Medical).
- If any required training is deficient, no action is taken on the officer’s certification. However, the deficiency in training (if any) must be completed before resuming active peace officer status.
From Medical Leave
Upon returning from medical leave, the agency shall contact POST to request that the officer’s certification status be changed from Active (Medical) to Active. At that time, POST will determine what training requirement (if any) is needed before returning to active peace officer status.
