Military Waiver of Training Requirement
Military Waiver
For a military waiver, the individual must be deployed by the U.S. military under orders for an extended period. While deployed, the individual’s certification and annual training requirements are on hold until the individual returns. Any deficiency in training must be completed before returning to active status. Depending on deployment dates, the individual will receive a waiver of some or all of the annual training requirements.
The following procedure applies to peace officers on active military deployment or have been on active military deployment in the training year.
Requesting Military Waiver
- A military waiver form (see below) must be completed by the individual’s primary agency, identifying that the individual is deployed on active U.S. Military duty.
- If the deployment is current, the form will include the start date, and the end date is left blank. If the deployment is over, the agency should include the start and end dates.
- To start the waiver process, please email the completed military waiver form (see below), signed by the chief administrative officer (or designee) to support@utahpost.org.
Military Waiver Calculation
- If the deployment occurs for the entire training year, the officer does not have a training requirement for that year and may become active upon return.
- If the deployment is a partial year, the hours are prorated by each full quarter worked. For each full quarter, the officer worked, 10 hours are required towards the 40-hour requirement.
- There is no waiver for Arrest Control, De-Escalation, Crisis Intervention, Special Needs, and Sexual Abuse/Assault Investigation requirements.
- For example, An Officer was deployed from 12/1 to 3/12 in the training year. The officer’s training requirement for the year would be 20 hours in total. Since the officer worked the first quarter (Jul-Sep) and the last quarter (Apr-Jun) of the training year. The partial-year officer will still need to fully complete the category requirements.
Active Military Peace Officer Status
- If the officer is on active deployment, the employment status is changed to Active (Military).
- If any required training is deficient, no action is taken on the officer’s certification. However, the deficiency in training (if any) must be completed before resuming active peace officer status.
Returning From Active Duty Status
Upon returning from active duty status, the agency shall contact POST to request that the officer’s certification status be changed from Active (Military) to Active. At that time, POST will determine what training requirement (if any) is needed before returning to active peace officer status.
